THE BALCO SAGA CONTINUES: Mosley vs Conte
Lawyers for Victor Conte, the disgraced owner and operator of BALCO Which had supplied performance enhancing drugs to elite athletes. In response, Judd Burstein’s Sugar Shane Mosley’s legal counsel was quotes as saying that he is salivating to get Victor Conte under cross examination in the defamation suit filed by his client against the drug company owner.
In a report in USA Today, the motion to dismiss from Conte’s camp was filed by Thomas Harvey and the documents submitted in the motion included an itemization of the drugs Mosley had purchased and used from Conte. Court documents indicated that Mosley had purchased $900 for EPO and $600 for steroids known as “the cream” and “the clear”. Conte added that the bill included $150 for blood check ups and $200 for the limousine Mosley had used to visit his then sprawling headquarters at Burlingame, Ca. Payment was made allegedly by Mosley in $500 cash and $1350 by check.
It may be remembered that Victor Conte was the founder and purveyor of BALCO which was claimed to the source of anabolic steroids and PEDs of elite athletes including Marion Jones, Tammy Thomas and Barry Bonds. Conte related in his written testimony that he watched Mosley shoot up the blood booster EPO. He claimed that the boxer knew what he was doing was illegal as these were prohibited substances. For his part, Mosley admitted previous use but claims ignorance that these were banned compounds. The case was brought about when Conte named Mosley as one of his clients which had used PEDs under BALCO’s wing. Mosley then countered with a defamation suit against Conte for dragging his name into the controversy. With this motion to dismiss, Conte provides intimate details of the alleged use of EPO and anabolic steroids by Mosley.
Legally, the statements of Conte may have some weight but providing receipts or the alleged checks would give greater credence. It is upon this that the lawyers of Mosley claim the utter falsity of these supposed events.
Conte countered the statement of Mosley’s counsel in an email stating that it was about time that Mosley gets what he deserves for his untruthful statements regarding his use of prohibited performance enhancing drugs. He reiterated that many athletes associated with BALCO who have lied about their use of the products have been banned from their respective sports, their records and awards removed and even served prison sentences. Conte seems to have had enough of the lies and being the scapegoat to these multi-million dollar atheletes.
These legal actions would have far reaching effects for Shane Mosley as the World Boxing Council could strip him of the junior middleweight crown he won when he defeated Oscar de la Hoya in 2003. This was roughly the period of time that the alleged drug use was done under BALCO auspices. Mosley had testified previously he had included EPO and steroids were included in his training prior to the said fight. As of writing, the WBC is still investigating the reported incident.
